Legal Services for Disabled Individuals

  • I represent disabled individuals who have encountered barriers in their attempt to use private business and public facilities.

  • I will take legal action against business and public agencies who have violated the access requirements of the ADA or California Title 24. Most often, this means filing a lawsuit.

  • I frequently hire an ADA expert to survey the property, report on what needs to be corrected and attend Court hearings where needed

  • When I file a lawsuit, I will seek a Court Order or a Settlement requiring the removal of barriers and compliance with disability regulations. Nearly all of the time, the Defendant agrees to correct the situation. The Defendant signs a written agreement stating what improvements will be made and how soon the improvement must be completed.

  • After there is an agreement as to what improvements the Defendant will make, I negotiate money compensation for Clients who have been injured, embarrassed or humiliated by the barriers that he or she encountered.

  • Once the Defendant has agreed to remove the barriers, and agreed to pay a specific amount of compensation to my Client, I deal with the Defendant to settle on a fair compensation to me for my time and the money I have spent bringing the lawsuit. I will never ask my clients to pay any portion of my fees.

  • I am with my clients every step of the way, and do most or all of the talking. It is rare that my clients have to do anything other than tell the Judge that they agree to the Settlement

  • Most cases are settled outside of the Courtroom or in a Settlement Conference with a Federal Magistrate. It is extremely rare that an ADA cases to go to trial.

  • I accept cases throughout Northern California. I generally file the cases in Federal Court, rather than State Court, because the Federal Judges and Magistrates are more familiar with the Americans with Disabilities Act.

  • The Americans with Disabilities Act is an incredible piece of legislation. It puts disabled people in charge of removing barriers in their own community, and requires the violators to pay the costs.
